These Terms of Service ("Terms") govern your access to and use of the Amara mobile application and related services (together, the "Service"), operated by Brilicept Limited ("Amara", "we", "us").
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1What Amara is - and isn't
Amara is a safety check-in companion. You set check-in times; if you do not confirm you're okay, Amara escalates and notifies the emergency contacts you have chosen.
Amara cannot detect that something has happened to you. It can only detect that you did not respond, which is not the same thing. Do not rely on the Service as your only safety measure.
2Eligibility and your account
You must be at least 18 years old to use the Service. You are responsible for the information you provide, for keeping it accurate, for the security of your sign-in credentials, and for all activity under your account. Tell us promptly if you believe someone else has accessed it.
3How the check-in service works
You choose a mode (Off, Standard, or Interval) along with your check-in times, your sleep window, and how long Amara waits at each escalation step. If you do not check in within the configured window, Amara begins the escalation process, which may include reminders, an alarm on your device, and notifications to your contacts by push notification and/or SMS.
Escalation deadlines are held on our servers, so an escalation can continue even if your device is offline or switched off. That said:
- Reminders, alarms, and escalation depend on things outside our control, including network and SMS availability, your device settings, battery, and operating-system restrictions.
- We do not guarantee that any notification will be delivered, received, read, or acted upon, or that it will arrive at a particular time.
- Location information, where shared, is approximate and may be out of date.
- You are responsible for setting your check-in schedule and sleep window sensibly, and for switching the Service to Off if you do not want check-ins to run.
4Your check-in and duress codes
You choose two separate codes: a check-in code, used to confirm you're okay, and a duress code, used when you need help but cannot say so openly. Keep both confidential. Anyone who knows your check-in code can check in as you and cancel an alert on your behalf.
- Entering the duress code triggers an alert to your contacts while the app deliberately shows a normal-looking screen. You accept that the app will not visibly confirm that a duress alert was raised.
- A duress alert cannot be cancelled with the duress code. Only your real check-in code will clear it. This is intentional.
- Your codes are hashed on our servers and cannot be recovered by us. If you forget your check-in code, you can reset it by re-verifying with your sign-in method.
5Alarms and notifications
By using the Service you agree to receive the notifications it depends on, including check-in reminders and escalation alarms. Later stages of an escalation are designed to be hard to miss and may sound at full volume and override your device's silent or Do Not Disturb settings. You can control this through your device's notification settings, but doing so may prevent Amara from reaching you.
6Emergency contacts
You may enroll contacts by phone number or, where they also use Amara, by linking to their account. The number you can enroll depends on your plan.
- Consent is your responsibility. You confirm that you have each contact's permission to provide their details and to have Amara message them on your behalf. Standard message rates may apply to them.
- Contacts may receive messages identifying you by name and indicating that you may need to be checked on, including a test message when you add them.
- If you have turned them on, an alert may include your last known location and your health notes. A linked contact may also retrieve your emergency instructions, but only while an escalation is active - and you are told whenever this happens.
- Keep contact details accurate. Alerts sent to an outdated number may reach the wrong person.
7If you are someone else's emergency contact
Accepting an invitation to be someone's contact means you may receive alerts about them. It does not create any legal duty to act, and Amara does not make you responsible for anyone's safety. You may stop being someone's contact at any time, and they will be told that you have. Information you receive about another person is shared with you for their safety - treat it as confidential and do not use it for any other purpose.
8Your content
Your health profile, emergency instructions, contact details, and check-in history are yours. We do not claim ownership of them. The licence you grant us is narrow and operational: strictly what we need to store your content, secure it, and deliver it to your chosen contacts when the Service calls for it. You are responsible for what you write, and for making sure you may share any information about other people that you include.
9Plans and billing
Amara is free to download. Some features and limits, including how many contacts you can enroll and whether alerts can be sent by SMS, depend on your plan, and the app shows your current limits. Where a paid plan is offered, it is billed through the Apple App Store or Google Play under their terms; renewals, cancellations, and refunds are handled there, and we do not process payments directly. If a plan's price or contents change, we will tell you beforehand.
10Sponsor messages
The Service may show sponsor messages relevant to your country on ordinary screens such as Home, Settings, and History. They never appear during onboarding, code entry, an alarm, an escalation, or any part of the duress flow. We are not responsible for the products or services of any third party featured in them.
11Acceptable use
You agree not to misuse the Service, including by interfering with its operation, attempting to access another person's account or data, using it to monitor or coerce someone else, or using it for any unlawful purpose. Do not raise false alerts. Deliberately triggering an escalation you know to be unfounded undermines the trust your contacts place in the Service and may cause real harm.
12Intellectual property
The Amara name, logo, app, website, content, and design are owned by Brilicept Limited and protected by intellectual property laws. These Terms give you a personal, non-transferable, non-exclusive licence to use the Service; they do not transfer any ownership. Feedback you send us is something we may use to improve the Service without owing you compensation or attribution.
13Changes to the Service and to these Terms
We may update, change, or discontinue parts of the Service, and we may update these Terms from time to time. Material changes will be communicated in the app. Continuing to use the Service after a change means you accept the updated Terms.
14Ending your account
You may stop using the Service at any time, and you can delete your account permanently from Settings → Manage account → Delete account: see our account deletion page. Deleting removes your safety net: once your account is gone, no one will be alerted if you stop checking in. We may suspend or terminate access where these Terms are breached.
15Disclaimers and limitation of liability
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
To the fullest extent permitted by law, Amara is not liable for any indirect, incidental, special, or consequential damages, nor for any injury, loss, or harm arising from a failure or delay in any check-in, alarm, escalation, notification, or message, from a contact's response or failure to respond, or from your reliance on the Service in place of emergency services. Some jurisdictions do not allow certain limitations; in those places, the limitations apply only as far as the law permits. Nothing in these Terms excludes liability that cannot lawfully be excluded.
16Governing law
These Terms are governed by the laws of the country in which Brilicept Limited is registered, without regard to its conflict-of-law rules. Disputes that cannot be resolved by contacting us first at amara@brilicept.com will be handled by the courts with jurisdiction over that location, except where local consumer-protection law gives you the right to bring a claim where you live.
